In the more than two decades since the Drug-Free Workplace Act was signed, the compliance and risk management landscape has evolved dramatically. The Drug-Free Workplace Act of 1988 requires covered organizations to implement a policy prohibiting the distribution, dispensation, possession or use of a controlled substance in the workplace; to notify employees that compliance with the policy is a condition of employment; to establish a drug-free awareness program; and to notify contract or grant agencies of certain employee convictions. Health centers must balance these compliance requirements as states legalize controlled substances and as employees are personally and professionally impacted by the opioid crisis.
In this webinar, we will review the requirements of the Drug-Free Workplace Act, including tips for establishing (or revising) your health center’s program and policy. The presenters will also discuss employee drug testing policies and procedures and the interaction with other federal laws and regulations, including the Americans with Disabilities Act and the Office of the Inspector General (OIG)’s exclusion authorities.

She has experience responding to privacy and security incidents, including determining whether there has been a breach, notifying patients and the government, and creating corrective action plans.
