Many health centers and their staff members rely on the professional liability coverage offered pursuant to the Health Center Federal Tort Claims Act (FTCA) program. From submitting the initial application for “deeming” status to handling malpractice claims and preparing for a site visit, FTCA program compliance is essential.

FTCA coverage depends upon whether the services provided are:

  • Within the health center’s 330 approved scope of project?
  • Within the scope of employment?
  • Provided to health center patients?

The answers to these questions are not simple. They often require legal analysis, interpretation of HRSA guidance and detailed understanding of medical malpractice. Failing to comply with the FTCA program requirements can be very costly for health centers and providers who can be left without any professional liability insurance for very expensive claims.

This one and a half day innovative and collaborative training lead by FTLF’s FTCA Practice Group Attorneys, Marty Bree, Molly Evans and Matthew Freedus discuss the biggest risks in FTCA coverage for health centers - from risks related to their applications and participation (either deeming or redeeming) in the FTCA program to common concerns around the complex set of rules on which FTCA coverage is based. This training will cover the most up-to-date FTCA "hot issues" that health centers across the country face in the ever-changing healthcare environment.

This session will also cover recent substantive changes in the FTCA program including the addition of FTCA coverage for volunteers, as well as the significant changes made to the deeming application to bring it into alignment with the Health Center Compliance Manual. Finally, this session will cover the most current FTCA "hot issues" that health centers across the country face in their day to day health center operations.

  • Review best practices in the FTCA claims process and discuss those actions that could jeopardize coverage for your health center;
  • Learn the types of insurance available and the decision-making process a health center needs to use to make an informed decision; and
  • Review the recent history of FTCA cases and explain the impact on health centers.

Martin Bree   

Marty has dedicated his entire career to serving the needs of health centers both inside government and out. From 1998 through 2004, Marty directed the Health Center Federal Tort Claims Act medical malpractice program, writing much of the policy that is in effect today. Matthew Freedus  

Matthew, a partner with the firm, represents health centers facing a variety of adverse administrative decisions and legal actions. Matthew defends clients in all phases of administrative review and judicial review, from the lowest level up to the Supreme Court, and also represents clients in affirmative litigation against states and other entities.
