High at Work: Examining How the Legalization of Marijuana Impacts Your Workplace Policies
Access the on-demand webinar here.
The rampant legalization of marijuana by state legislatures has placed businesses in the unenviable position of having to reassess the legality and efficacy of their workplace policies. With 39 states now permitting medicinal and/or recreational usage, businesses must understand and resolve a myriad of legal considerations arising from the impact of legalization in the workplace, such as:
- Are we obligated to accommodate the medical use of marijuana under the ADA?
- Can we terminate an employee for being under the influence of medical marijuana while at work?
- As a federal grantee, how can we reconcile our state’s legalization of marijuana with our obligations under the Drug Free Workplace Act?
- How do we balance our legitimate business interest in protecting the health and safety of the workplace with our employee’s state protected rights to use marijuana recreationally?
- What policies do we need to assess in furtherance of managing our compliance obligations under the law?
- What if we have employees who work remotely in a state that permits the use of marijuana, but the state where our office is located prohibits marijuana usage?
- Can we conduct pre-employment drug screening or drug test our current employees for marijuana use?
Join us for this webinar where we will discuss these issues as well as employers’ conflicting legal obligations under state and federal laws. We will also update you on the status of federal legislation to remove marijuana from the controlled substance list. And, we will discuss how state legalization of marijuana impacts workplace policies such as accommodations, safety, drug testing and screening, and discipline, and the best practices that organizations can utilize to comply with the marijuana laws in their state.
