There are numerous reasons that an individual or entity may be excluded from participating in federal or state health care programs – from committing Medicare and Medicaid fraud, unlawfully dispensing controlled substances or defaulting on education loans or scholarships. The Office of the Inspector General (OIG), the System for Award Management (SAM) and most state Medicaid agencies regularly publish lists of excluded individuals and entities.

Health care entities, including health centers, are responsible for reviewing these lists to ensure that their employees, volunteers, Board members, contractors and vendors have not been excluded. Health care entities must respond appropriately if an individual or entity is listed. Common compliance challenges related to exclusion screening in health centers include:

  • Determining who should be screened: Providers? C-Suite? All employees? Board members? Volunteers? Students? Vendors/contractors?
  • Assigning responsibility for screening: Human Resources? Credentialing? Finance? Compliance? Outsourcing? 
  • Determining the frequency of screening: Upon hire? Annually? Monthly?
  • Developing a procedure for responding: Should the employee be taken off the schedule? Can the employee continue to work in a non-clinical capacity? Should the health center disclose to the government?

In this webinar we will review the various exclusion lists, explain strategies for limiting risk related to affiliating with an excluded individual or entity, and discuss key provisions for your organization’s exclusion screening policy and procedure.
