High Impact: Marijuana Rescheduling and the New FQHC Compliance Landscape

It’s the most significant change to federal marijuana law in more than five decades: the U.S. Department of Justice announced this spring that it would move FDA-approved products and state-licensed medical marijuana to the more flexible Schedule III of the Controlled Substances Act (CSA), while adult-use (recreational) marijuana remains subject to the strict Schedule I classification substance pending the outcome of a June 29 hearing.

For federally qualified health centers (FQHCs) bound by the Controlled Substances Act, implementation of these changes fundamentally could alter long-time marijuana policies relating to prescriptions, dispensing, and research.

This webinar will focus on the implications of loosened marijuana restrictions on health centers.  Specifically, the webinar will address questions including:

  • Can providers at FQHCs now prescribe medical cannabis to treat patients’ underlying conditions without risk?
  • HHS policies require compliance with federal laws as a condition of federal funding.  If an FQHC (or provider within an FQHC) refuses access to cannabis medicines, will this refusal to provide patient care be considered discrimination?
  • How does the rescheduling change impact patients residing in the ten states that currently have not legalized medical cannabis at the state level—and what are the repercussions for prescribing cannabis use in those states?
  • What new compliance obligations are in store— in areas such as recordkeeping, reporting or security?

The webinar also will offer practical guidance on how the heightened flexibility under Schedule III should prompt health centers to enact changes to policies and procedures.
