All Federal grantees must report certain activities potentially affecting their federal award, including fraud and fraud-like matters, certain conflicts of interest, and certain criminal, civil, and administrative proceedings.

With the promulgation of the Uniform Guidance in December 2014, OMB moved, in key areas, from voluntary disclosures to mandatory reporting. In January 2016, mandatory reporting expanded further with requirements under the Federal Awardee Performance and Integrity Information System (“FAPIIS”). With the recently (fall 2023) proposed updates to the Uniform Guidance, OMB has proposed expanding mandatory reporting obligations to include Civil False Claims Act violations — a proposed change that is very likely to be adopted.

In this webinar, attorneys Rosie Dawn Griffin and Scott S. Sheffler will provide an overview of the core reporting requirements, address areas of ambiguity, and discuss considerations relevant to the internal evaluation of whether a disclosure may be required.

Rosie Dawn Griffin

Serving as a Partner in the Federal Grants, Health Care, Litigation and Government Contracts practice groups, Rosie counsels and litigates on behalf of a diverse group of federal grant recipients, including federally qualified health centers and Head Start programs. Ms. Griffin also defends clients across a wide range of business sectors facing investigations and litigation under the False Claims Act (FCA) and similar statutes. Ms. Griffin brings deep knowledge to this work, and a unique perspective, having worked for many years at an elite relator’s side firm representing whistleblowers in FCA cases. Scott Sheffler 

Scott Sheffler is a Partner with the firm in the Federal Grants and Health Care practice groups. He advises clients on matters of federal grant law, government contract law, and health care law. Scott assists clients with the myriad requirements that apply upon acceptance of federal grant funding, including the administrative requirements and cost principles established in the Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards (Uniform Guidance), the Office of Management and Budget (OMB) Circulars that preceded the Uniform Guidance, and program-specific statutory and regulatory funding conditions.
