The FTCA Summit will provide up-to-the-moment analysis of the Trump Administration's actions and their impact on FTCA coverage for health centers. 


Join us in for a two-day immersive experience in how the Health Center Federal Tort Claims Act (FTCA) program really works.  The Summit will also address substantive changes in the FTCA program, current and recently resolved cases, and significant revisions made to the deeming application.

About the Summit

Health centers and their staff members rely on the comprehensive professional liability protection offered by the FTCA program. From submitting the initial application for “deeming” status to handling malpractice claims and preparing for a site visit, FTCA program compliance is essential.

FTCA coverage is dependent on whether the services provided are:

  • Within the health center’s Section 330 approved scope of project
  • Within the scope of employment
  • Provided to health center patients

Determining whether FTCA coverage applies is not simple. It requires legal analysis, interpretation of HRSA guidance, understanding of the FTCA proclaim process and an appreciation of medical malpractice theory. Failing to comply with any of the FTCA program requirements can be very costly for health centers and providers who can be left without any professional liability insurance for very expensive claims.

Throughout the Summit, our attorneys will discuss the top areas in FTCA coverage for health centers, including risks related to:

  • FTCA Deeming Application.  The deeming/redeeming application process is fraught with challenges. Understanding how to complete a deeming application by providing the information that reviewers will be looking for will go a long way toward making the application process less stressful and more effective.
  • The leading FTCA "hot issues" that health centers across the country face in the ever-changing healthcare environment
  • FTCA Site Visits. HRSA has implemented random targeted FTCA site visits. We will study the site visit protocol and provide recommendations on working with and/or surviving FTCA site visit reviewers.
  • Common pitfalls around FTCA coverage

Marty J. Bree

Marty Bree has dedicated his entire career to serving the needs of health centers both inside government and out. From 1998 through 2004, Marty directed the Health Center Federal Tort Claims Act medical malpractice program, writing much of the policy that is in effect today. Marty Bree has more than thirty years of experience working with health centers and the FTCA Program. Marty is a member of the New Jersey Bar and is not licensed in Washington, DC. Kathy S. Ghiladi

Kathy Ghiladi is a Partner in the firm's Health Care and Federal Grants practice groups. Her practice focuses on government-sponsored health care programs such as Medicaid, CHIP, Medicare and the Affordable Care Act, with an emphasis on payment/reimbursement and compliance-related issues. Kathy also represents clients in government investigations and audits, litigation before federal and state courts, as well as in administrative appeals with the U.S. Department of Health and Human Services Departmental Appeals Board (DAB) and Provider Reimbursement Review Board (PRRB). She provides reimbursement counseling, including identification, reporting, and repayment of overpayments, with respect to Medicare, Medicaid and private third-party payors. [Full Bio]
