Subrecipient Non-Compliance

With the advent of the Uniform Guidance, subrecipient monitoring has become a significant area of focus by federal awarding agencies. The Uniform Guidance instructs that grantees are to evaluate the risk of each subaward/subrecipient, then monitor each subrecipient’s performance based upon that risk assessment. However, it does not explain how grantees should structure their subrecipient agreements to create the opportunity to conduct that monitoring or establish the legal rights necessary to take effective action in the event noncompliance is identified. This can lead to grantees acting with too light or too heavy a touch when they perceive a possible area of noncompliance on the part of a subrecipient. In this webinar, Partner Scott S. Sheffler will discuss matters of subrecipient noncompliance within the broader federal grant compliance framework, connecting potential enforcement mechanisms to important agreement terms and risk for the grantee entity vis-à-vis its federal agency funder.
