Concept to Practice: Standards of Conduct and Compliance

In the federal grants system, we often hear that grantees must exhibit high ethical standards, commitments to and cultures of compliance, and dedication to transparency in the management of federal funds.  As a practical matter, these ethical standards are generally implemented through a combination of:

  • Financial Management policies;
  • Document Retention and Mandatory Reporting obligations incorporated into grant terms;
  • Internal Controls as operationalized through policies, procedures, and practices;
  • Conflict of Interest policies; and
  • Whistleblower Protection policies.

In this course, we will analyze background legal requirements and strategies for operationalizing compliance mechanisms.  We will work from the underlying regulatory standards up to documented compliance measures that can be used to both (i) foster controls and (ii) demonstrate those controls to after-the-fact auditors and agency reviewing officials.  In doing so, we will work through commonly encountered conflict of interest scenarios in a discussion format.  Further, we will use practical scenarios to analyze circumstances that can turn an honest mistake into a potential fraud allegation—and best practices to avoid the same.

Sample policies and tools will be provided as part of the course and will serve as a basis for practical portions of the presentation.  Questions and discussion are welcome throughout!
