Federal Tort Claims Act (FTCA) coverage requires health centers to conduct regular, structured risk assessments focused on patient safety and clinical quality. This two-part series will cover how to identify and evaluate potential risks, document findings, and develop responsive strategies that meet FTCA program expectations.  

In addition, health centers must submit an annual risk management report to their Boards, a requirement that has been the source of compliance notices in recent years. The attorneys will address how to report outcomes to leadership and HRSA, and how to align assessments with broader compliance and quality initiatives. 

The first session in the series will walk participants through FTCA risk assessment requirements through the lens of the HRSA review of risk management systems, with a focus on quarterly risk reporting and the development of the annual report to the board. In the second session, the presenters will turn their focus on operationalizing the risk assessment requirements, ongoing monitoring requirements, and Board responsibilities.  

The discussion will also highlight how FTCA risk assessments can be integrated into broader compliance and quality improvement efforts, such as emergency preparedness and operational oversight. Practical tools and examples will help participants strengthen their approach to risk mitigation while supporting continued FTCA deeming.

From 1998 - 2004, Marty directed the Health Center Federal Tort Claims Act medical malpractice program, writing much of the policy that is in effect today. He has more than 30 years of experience working with health centers and the FTCA Program. Marty is a member of the New Jersey Bar and is not licensed in Washington, DC.
