With the advent of the Build America, Buy America Act (BABA), essentially all federally supported infrastructure projects are now subject to robust domestic sourcing requirements for the iron/steel, manufactured products, and construction materials incorporated into the resulting work.  These requirements will have, and are already having, a significant impact on infrastructure projects across programs, from those funded by the Department of Transportation (DOT), the Environmental Protection Agency (EPA), the Department of Housing and Urban Development (HUD), and even agencies with primary missions of funding social services and research.

As each agency has navigated its way through the new requirements, we enter 2024 with most new awards for infrastructure projects now subject to these rules – but also subject to a web of potential exceptions and overlap with historical requirements in certain programs, most notably DOT-funded projects.  Join Partner Scott S.
