Providing Care to Justice-Involved Individuals Reentering the Community

HRSA’s recently issued Draft Policy Information Notice (PIN) #2024-005 marks a significant expansion of the health center program, explicitly contemplating that health centers may serve incarcerated/detained individuals who are within 90 days of their scheduled or expected release (referred to as “justice-involved individuals reentering the community” or “JI-R individuals”). In addition to the draft PIN, HRSA announced the availability of $51 million in funding to implement innovative approaches to support transitions in care for people leaving incarceration.

Despite the progress in allowing services to certain incarcerated individuals, it is critical to note that the draft PIN limits when and how a health center can operate a “carceral site” within the scope of its health center project. For example, the draft PIN establishes that health centers cannot assume the obligation of the local or state government responsible for the care and custody of the JI-R individual to provide health care, or otherwise operate its medical program.

Given the complexities (and limitations) surrounding what health centers can – and cannot do – in providing care to incarcerated individuals within the scope of the health center project, health centers should proceed with caution and care in establishing carceral setting initiatives. This webinar will explore potential models for serving JI-R individuals, key legal considerations (such as maintaining Federal Tort Claims Act coverage), and anticipated legal pitfalls. The presentation will include a checklist of considerations to help inform and guide the evaluation and planning process.
