Every grantee knows that “sole source” and “limited source” procurements are high-risk events when using federal funds. Yet, the Uniform Guidance does not offer much clarity on when sole source and limited source procurements are permissible. Despite listing potential justifications of “only available from a single source,” “public emergencies,” and the like, grant regulations do not explain in depth what might qualify as fitting within these limited, loosely phrased general categories.  

With grantees expected to account for the costs of sole-source contracts well after-the fact, particularly as audits or other types of federal funder monitoring of award expenditures will likely occur years after sole-sourcing a federally funded procurement and grantee issued corresponding payments, sole-sourcing clearly tests grantees’ risk tolerance. It is vital to understand the requirements around sole-sourcing to enhance a grantee’s ability to justify expenditures and reduce the risk of challenged costs and ensuing disallowances.
