State laws permit minors (individuals who are younger than 18) to consent to a range of health care services without parental consent.  Known as “confidential services,” such health care services often include sexual and reproductive health care, mental health care and substance use disorder services.  The state laws are designed to encourage minors to seek the health care services they need.

While many of these state laws have been in place for decades, providers of confidential services have faced new and unique legal and compliance challenges due to the increased use of patient portals and apps, the requirements to allow access to health information under the Information Blocking Rule, and the increased pressure and scrutiny from politicians and advocacy groups advocating for parental rights.

In this webinar, the presenters will discuss the common consent models states use for minors seeking confidential services.  The presenters will discuss key questions to ask your electronic health record (EHR) vendor related to patient and proxy access controls and they will identify key policies and procedures to review related to providing confidential services for minors.

Dianne counsels health centers and other organizations on developing compliance programs that include the OIG’s seven elements, respond to identified compliance risk areas, and reflect the organization’s culture. Dianne also advises health centers and other organizations on patient privacy and confidentiality, including the HIPAA Privacy Rule and 42 CFR Part 2. She has experience responding to privacy and security incidents, including determining whether there has been a breach, notifying patients and the government, and creating corrective action plans.
